Rental Terms and Conditions
Introduction
These Rental Terms and Conditions ("Rental Terms") govern the process of property rental transactions facilitated through the Platform. The Platform is a digital marketplace for property rental transactions, enabling property owners, tenants, and licensed agents to list properties, schedule viewings, submit and accept offers, and communicate in a transparent and structured manner.
In these Rental Terms, "Tenant" refers to a Verified User interested in renting a property and "Landlord" refers to a Verified User offering a property for rent. "Agent" refers to an authorized real estate broker licensed by a real estate authority (e.g. RERA or ADREC or the relevant authority in that jurisdiction) listing a unit on behalf of a landlord.
By using the Platform to list a property for rent, book viewing appointments, submit offers, or otherwise participate in a property rental transaction, you agree to be bound by these Rental Terms.
These Rental Terms form an integral part of the General Terms and Conditions ("General Terms"), and by participating in any property transaction on the Platform, you expressly agree to be bound by both, the General Terms and Rental Terms. In the event of any conflict between these Rental Terms and the General Terms, these Rental Terms shall prevail to the extent the conflict relates specifically to property rental transactions.
All capitalised terms used but not defined in these Rental Terms shall have the meanings assigned to them in the General Terms.
If you do not agree to these Rental Terms or General Terms at any point, you must immediately discontinue your use of the Platform.
User Verification
To access key features of the Platform, including scheduling property viewings, submitting offers, and listing properties for rent, users must first complete the verification process and become a Verified User. The verification process requires providing certain details and documents, depending on whether the user is registering as a Landlord or Tenant Verification requirements are detailed in the General Terms.
Eligibility: Users must be at least 18 years old (or the legal age of majority in their jurisdiction) and have full legal capacity to contract in the UAE. By registering, you represent that you meet these age and capacity requirements and will provide valid identification (e.g. passport, Emirates ID) and any other documents required by law. Users must not impersonate others or share accounts. Neuk reserves the right to suspend or terminate any account that does not meet eligibility criteria or provides false information.
Verification and Accuracy: All users must complete the Platform's verification process before accessing core features. Users agree to provide complete and accurate information about themselves and keep it up-to-date. Any information submitted (including proof of identity, address, and, if applicable, proof of agency or ownership) must be truthful. Neuk may request supporting documents (such as title deeds or power of attorney) at any time. False or misleading information may lead to removal of listings and suspension of the account.
Agent Licensing: Any user acting as a real estate agent or broker must hold and provide a valid RERA (Dubai) or ADREC (Abu Dhabi) license number. Agents warrant that they are in good standing with the relevant authority and will comply with all applicable real estate regulations and ethical codes. RERA-licensed brokers are subject to RERA's licensing and advertising requirements. Agents agree to furnish Neuk with their license details and to update them promptly if they change or expire.
Once verified, users gain access to Platform functionalities based on their role:
- Tenants can schedule rental property viewings, submit offers and communicate with Landlords.
- Landlords can list properties for rent, utilise third party services offered by the neuk Companies to enhance or modify their listings, manage viewings, accept offers and communicate with Tenants.
By completing the verification process, becoming a Verified User and using the Platform, you agree to be bound by these Rental Terms.
Listing a Property
Accuracy of Listings: Landlords are responsible for ensuring all property listings are truthful, complete, and compliant with UAE law. Listings must include required details such as rent amount, payment terms (e.g. number of cheques), property size, location, and any legal information mandated by local regulations. Misleading or false listings are prohibited. RERA actively regulates advertisements to prevent misleading information, so all listings should be factual. Neuk may remove any listing that violates these rules or request edits to bring it into compliance. Landlords are responsible for ensuring that each listing is supported by valid ownership or marketing authority documentation.
Proof of Authority: Before listing a property, the Landlords must have legal authority to rent the property. Landlords must hold clear title or authorization from co-owners; Users must keep copies of ownership documents or letters of authorization on file and provide them to Neuk upon request. Providing a listing constitutes a warranty that the user has the right to lease the property (either as owner or authorized agent).
Warranties: By listing a property, the Landlord warrants that the property is not subject to undisclosed encumbrances or legal restrictions that would invalidate the lease.
Listing properties on the Platform is free of charge. However, certain advanced features — such as premium listing visibility, unlimited tenant messages, or enhanced analytics — may require payment of a Fee as outlined in the Platform's pricing schedule. Neuk reserves the right to update or modify available features and corresponding fees at any time.
Listing Content and Licensing: All content uploaded (descriptions, photos, floorplans, etc.) must not infringe on third-party rights. By submitting content, you grant Neuk a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and display this content on the Platform and in marketing materials related to the property. This license survives any termination of the listing. Users retain ownership of their content, but Neuk may use it to operate and promote the service. If a Landlord/Agent removes a listing or account, Neuk will cease new uses of those materials, but any published content already displayed (on the site or in marketing) may remain for a reasonable period.
Appointment Booking
Scheduling Appointments: Tenants can use the Platform to contact Landlords or Agents directly to schedule property viewings. Landlords or agents can manage viewing requests digitally through the Platform and are responsible for confirming or responding to appointment requests promptly. Both the Landlord and Tenant should refrain from repeated last minute cancellations or no shows. All property viewing appointments and communications about appointments may be conducted through the Platform's messaging any confirmed viewing is arranged at no cost via the Platform.
Tenant Responsibilities at Appointments: Tenants should arrive on time for scheduled appointments and may be required to present identification to verify they are the person who booked the appointment. During the property viewing, Tenants are expected to conduct themselves respectfully, should not cause any damage to the property and should limit their inspection to reasonable, non-intrusive actions (unless explicit permission for further inspection is given by the Landlord).
Landlord/Agent Responsibilities at Appointments: Landlord must ensure the property is accessible and in a safe, presentable condition at the agreed appointment time. The Landlord or their agent/representative should be present to greet the Tenant and conduct the viewing. Landlords/ must provide truthful and complete information about the property and disclose any known defects or important issues as required by law. Any willful withholding of critical information (such as structural issues or pending legal orders) may be unlawful. Landlords are expected to provide truthful and accurate information about the property during the appointment, and to disclose any important known issues or defects as required by applicable law.
Communications and Offers
Users should conduct all Rental-related communications in good faith. Both parties may use the Platform's messaging system to ask questions, negotiate, and make or review offers. Neuk is not responsible for off-Platform communications or transactions. Users are recommended not to initiate personal chats or email exchanges outside of official channels until a legitimate interest is established. Neuk does not monitor private messages, but may review content for compliance if necessary. .Any inquiry or offer sent through the Platform does not constitute a binding contract. Neither party is obligated to accept an offer until a formal written lease is signed. All negotiations remain subject to mutual agreement. Neuk merely facilitates communication; it does not negotiate or finalize transactions on behalf of users.
Tenancy Agreement and Payments
As the Platform is a digital marketplace for Tenants to search and make offers on rental listings, and Landlords to upload rental listings and accept offers, neuk does not intervene in the negotiations or guarantee a successful tenancy agreement.
However, through the Platform, neuk does provide access to sample tenancy agreements and inspection reports for use by the parties. Such access should not be construed as professional advice.
A binding tenancy arises only when a Tenant and Landlord (or their Agents) execute a written lease agreement in accordance with UAE law. The Landlord and Tenant must prepare and sign a lease that meets all legal requirements (including tenancy duration, rent, deposit, payment schedule, etc.). Parties are responsible for ensuring the lease complies with all relevant regulations. Neuk provides access to sample tenancy agreement forms and inspection templates for convenience, but these are not legal advice and do not substitute for a properly drafted contract.
In line with local regulations, the Landlord (or authorized Agent) must register the signed tenancy with the appropriate government portal. For Dubai properties, the lease must be registered via the Ejari system to legalize the tenancy. For Abu Dhabi, landlords must register leases through the Tawtheeq (TAMM) system. Registration costs (Ejari/Tawtheeq fees) are the responsibility of the parties, and failure to register may invalidate the contract or hinder enforcement. Neuk is not liable for any consequences of failing to register.
The final rent, security deposit, payment terms, and any landlord/tenant obligations will be those set out in the signed lease, regardless of what was listed or discussed on the Platform. If there is any discrepancy, the written lease prevails. Neuk has no role in ensuring fairness of lease terms and is not liable for terms that might conflict with RERA/ADREC rules or for errors in the final agreement.
Neuk will never ask you to pay money or share sensitive financial details (like bank passwords or full credit card numbers) via email or personal message. Users should be cautious of phishing or fraud attempts. Payments or fees requested outside the Platform's secure channels, or by individuals not identified as Landlord/Agent in the listing, should be treated as suspicious. Always verify the payee's identity before transferring funds. Users are encouraged to report any suspected fraud or requests for unauthorized payments to Neuk immediately.
If you cancel a paid premium feature, any refunds will be handled as set out in Neuk's general Terms and Pricing Schedule. Generally, listing fees (if any) are nonrefundable once the service has been rendered, unless Neuk has made a material error.
In addition, neuk does not operate as an escrow services provider, financial institution or financial advisor, and thus does not process rental payments or hold rental deposits.
All payment transactions should occur outside of the Platform between the Landlord and Tenant directly.
Third-Party Services
The neuk Companies might also offer or recommend other third-party services to support rental process. Neuk Companies might offer introductions to third-party services such as photographers, cleaning services, or home staging companies to help prepare the property for rent. All such services are provided by independent third parties, not by a neuk Company. If a Landlord decides to engage any of these services, the contract will be directly between the Landlord and the third-party service provider.
Any recommendation or suggestion of a third-party service on the Platform is not an endorsement or guarantee of that service. The Landlord should exercise their own judgment and due diligence when selecting any third-party service provider. The neuk Companies disclaim all liability for the actions, errors, or omissions of any third-party service providers. Any dispute or issue that arises from using a third-party service must be resolved between the Landlord and that third-party service provider.
All third-party service providers suggested via the Platform are independent entities. They are not agents, employees or partners of neuk, and neuk has no control over how they deliver their services. Similarly, these providers have no authority to speak for or obligate neuk. Ultimately, engaging a third-party service is the user's choice and risk. neuk's role is limited to making the connection or providing general information on the third-party service provider.
Any contract you enter with a third-party service provider is solely between you and that provider. Neuk has no control over, and assumes no liability for, the performance, services, errors, or omissions of these third parties. You are responsible for performing your own due diligence before hiring any such service.
Liability
Neuk acts as a facilitator of rental property transactions, providing the Platform for Landlords, Tenants, and licensed Brokers to connect and manage the steps of a property rental. Neuk is not a party to the actual tenancy agreement between the Landlord and Tenant, does not engage in property management services, and does not collect rental payments or security deposits. As such, Neuk shall not be liable for the actual performance of the Landlord, Tenant, or Broker, or representatives of either, in completing a tenancy agreement. The obligation to rent the property lies solely with the Landlord and Tenant once they enter into a tenancy agreement. Neuk shall not be liable for any losses, costs, expenses, or damages arising from the failure of the Landlord, Tenant, or Agent to meet their contractual obligations, any issues related to the property itself, or their use of the Platform.
Licensed Brokers using the Platform are responsible for ensuring that their activities comply with all applicable real estate regulations and licensing requirements. Neuk does not assume responsibility for the conduct, representations, or accuracy of information provided by Brokers, and any engagement between a Broker, Landlord, or Tenant is made at their own discretion and risk.
While neuk strives to maintain a high standard of accuracy and reliability on the Platform, neuk does not guarantee that all information provided by users or third parties is correct, complete, or up-to-date. Property listings, appointment availability, offer details, and other content on the Platform will be provided by the Landlord, and neuk cannot independently verify every piece of data received from a Landlord or Tenant. Tenants are responsible for conducting their own due diligence on properties they are interested in. Landlords are responsible for ensuring that information they provide on the listed property is accurate, truthful and not misleading. neuk will not be liable for damages arising from inaccuracies or omissions in listings or communications on the Platform, except to the extent that neuk failed to accurately relay information that was explicitly confirmed.
The Platform is provided "as is" and "as available," without any express warranty. Neuk does not guarantee that listings are accurate, complete, or current. Listings are user provided content; Neuk cannot verify every detail. Tenants must conduct their own inspections and verify all material facts before committing to rent. Neuk does not guarantee that any listing will result in a lease or that any user will find a suitable property. Neust strives for reliability but does not warrant uninterrupted or error-free operation.
To the fullest extent permitted by applicable law, in no event shall Neuk or its affiliates be liable for any indirect, incidental, consequential, punitive, or special damages (including lost profits, lost data, or business interruption) arising out of or related to the use of the Platform or any property transaction, even if advised of the possibility of such damages. Neuk's total aggregate liability for all claims arising under these Rental Terms shall not exceed the total Fees (if any) actually paid by you to Neuk for the relevant listing or premium service in the twelve (12) months preceding the event giving rise to the claim. If no Fees were paid, Neuk shall have no liability. Some jurisdictions do not allow exclusion of certain liabilities, so this limitation applies only to the maximum extent permitted by law.
Verified Users agree to indemnify, defend, and hold harmless neuk, its affiliates, officers, agents, employees, and partners from any claims, liabilities, losses, damages, or expenses (including legal fees) arising from:
- their violation of these Rental Terms; and
- their use of our Platform.
Indemnity and User Responsibility
Indemnity: You agree to indemnify, defend, and hold harmless Neuk (and its officers, agents, partners, and employees) from any claims, liabilities, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Rental Terms or your violation of any law or rights of a third party. This includes any claims resulting from your content (listings, messages, photos), your interactions with other users, or your negligent or willful misconduct. Neuk reserves the right (at your expense) to participate in the defense of any third-party claim related to your activity.
User Conduct: You are responsible for all actions taken under your account. You must not use the Platform for any fraudulent or illegal purpose. This includes but is not limited to: posting fraudulent listings, impersonating others, sending malicious software, or engaging in harassment. Neuk may terminate or suspend accounts that appear to be engaged in fraud or abuse. Users should notify Neuk immediately if they become aware of any breach of security or unauthorized use of their account.
Force Majeure
Neither Neuk nor any user shall be liable for any delay or failure to perform obligations under these Rental Terms (other than payment obligations) due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, labor strikes, pandemics, natural disasters, or government orders. The party affected by such an event shall promptly notify the other. Performance under these terms will be suspended during the force majeure event. If the event persists for more than 30 days, either party may terminate the transaction without penalty by giving written notice.
Data Protection and Privacy
Compliance with UAE Data Law: Neuk collects and processes personal data in accordance with the UAE Federal Decree-Law No. 45 of 2021 (the PDPL) and other applicable privacy laws. We only collect personal data that you voluntarily provide (such as your name, contact details, Emirates ID, or passport information) for purposes of verification and facilitating rentals. By using the Platform, you consent to this processing. You have the right to access, correct, or request deletion of your personal data in our systems. You may exercise these rights by contacting Neuk's Data Protection Officer as described in our Privacy Policy. Neuk will retain your data only as long as necessary to provide services and as required by law.
Security Measures: Neuk implements reasonable technical and organizational safeguards to protect your personal information. However, no system can be completely secure. Neuk cannot guarantee that unauthorized third parties will never be able to defeat those measures or access your data. In case of a data breach affecting personal information, Neuk will comply with any notification requirements under the PDPL and notify affected users as required.
Privacy Policy Reference: Details about how Neuk uses cookies, shares data with service providers, and protects privacy are set out in the Neuk Privacy Policy. By using the Platform, you acknowledge you have read and understood that policy.
Severability and Amendment Rights
If any provision of these Rental Terms is held invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect. The invalid provision shall be interpreted to the maximum extent permitted by law, or replaced by a lawful provision that most closely achieves the original intent. Neuk reserves the right to amend or update these Rental Terms at any time. When changes are made, Neuk will post the revised terms on the Platform and update the "Last Updated" date. Material changes will be communicated to users (for example, by email). Your continued use of the Platform after any amendment becomes effective constitutes your acceptance of the new terms. If you do not agree with a change, you must stop using the Platform.
Content Licensing (for Listings and Photos)
License to Neuk: By uploading any text, photos, floorplans, or other content to the Platform, you grant Neuk and its affiliates a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, display, and distribute that content in connection with operating and promoting the Platform and related services. This license allows Neuk to list and market your property across the Platform, our social media, and any advertising channels we use.
Ownership and Rights: You retain all ownership rights to the content you upload. You represent and warrant that you own or have all necessary rights to grant the above license to Neuk, and that the content does not infringe any third-party intellectual property or privacy rights. Neuk may remove or disable user content that it believes, in good faith, infringes rights of others. Neuk does not claim ownership of your content beyond this limited license for Platform use.
Removals: If you choose to delete a listing or close your account, Neuk will stop using your content going forward. However, Neuk may retain archived copies for backup and legal compliance purposes and may continue to display your content in cached or archived forms for a reasonable time.
Dispute Resolution
Any dispute between the Landlord and Tenant arising out of the transaction is fundamentally between those two parties. Neuk is not legally responsible for resolving such disputes nor shall be considered a party to any such disputes. We encourage Landlords and Tenants to communicate and attempt to resolve disagreements in good faith.
Neuk does not arbitrate or adjudicate disputes and any legal disputes between the parties must be resolved through the mechanisms provided in the tenancy agreement.
By proceeding with any property rental transaction on the Platform, you acknowledge that you have read, understood, and agree to these Rental Terms. These Rental Terms are designed to create a fair and transparent process for all parties involved and to clarify the role of the neuk Companies in your property transactions. If you do not agree with any part of these Rental Terms, you should not use the Platform for property rental transactions. Governing law and jurisdiction
If a dispute arises between you and neuk, we strongly encourage you to first contact us directly to seek a resolution by emailing support@neuk.ae. We will review your complaint and do our best to address it.
If a dispute between us cannot be resolved amicably, then to the fullest extent permitted by applicable law, these Rental Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of the Dubai International Financial Centre ("DIFC") and will be interpreted accordingly. You irrevocably agree that the DIFC courts will have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, your use of our Services or these Rental Terms, and all matters arising from them (including any dispute relating to the existence, validity or termination of these Rental Terms, or any contractual or non-contractual obligation).
